Calif. Court Amends DePuy Hip CMO, Issues Stipulated Order Regarding Non-Revision Cases

SAN FRANCISCO –– The California court overseeing that state’s coordinated docket for DePuy ASR Hip System claims has amended its latest Case Management Order to allow plaintiffs whose cases were dismissed without prejudice to re-file directly into the coordinated docket within one year of a revision surgery.
In the May 23 document, the California Superior Court for San Francisco County noted that the defendants had agreed to toll the statutes of limitations and repose in cases where plaintiffs had not undergone a revision surgery in exchange for a dismissal of such claims without prejudice.
