Pa. Appeals Court Vacates $27.6 Million Zimmer Knee Verdict as Excessive and Unsupported by Evidence

PHILADELPHIA — A Pennsylvania appeals court has vacated a $27.6 million verdict rendered in favor of the recipient of a Zimmer Gender Solutions Knee replacement device and her husband, finding the award was excessive and “clearly beyond what the evidence warrants.”
On June 4, the Pennsylvania Superior Court remanded the matter to the Philadelphia County Court of Common Pleas to remit the verdict.
Margo Polett underwent bilateral knee surgery at age 67 in June 2006. Dr. Richard Booth performed both operations and conducted follow-up visits.
