Action Involving Olympus Scope Allegedly Contaminated with ‘Superbug’ Transferred to North Carolina

PHILADELPHIA — A Pennsylvania federal judge has transferred to North Carolina an action in which the plaintiff alleges that her husband’s death was caused by a “superbug” bacteria he contracted during a routine endoscopic procedure in which a contaminated Olympus duodenoscope was used.
In a May 24 order, Judge John R. Padova of the U.S. District Court for the Eastern District of Pennsylvania found a majority of the factors favor transfer to North Carolina, including the location of the events, the convenience of the witnesses, and the state’s interest in the action.
