DePuy Backs Post-Trial Motions, Maintains ‘Gargantuan’ $502 Million Verdict is Excessive

DALLAS –– The defendants against which a $502 million verdict was entered in five Pinnacle Hip Implant cases have filed a reply brief backing its post-trial motions, maintaining that the plaintiffs’ opposition “misapplies the applicable law, distorts the evidence in the record and ignores the unfair prejudice defendants suffered throughout the trial.”

In the May 5 reply brief filed in the U.S. District Court for the Northern District of Texas, the defendants said that, under 5th Circuit law, a remittitur or new trial is appropriate in cases like this, where the “compensatory damages are grossly disproportionate to the injuries sustained.”
