Plaintiff Failed to Prove Zyprexa Caused Weight Gain, Diabetes, N.J. Appellate Court Affirms

NEWARK, N.J. — A pro se plaintiff failed to prove that the antipsychotic drug Zyprexa caused her to gain a significant amount of weight and develop diabetes, a New Jersey appellate court has ruled in affirming an award of summary judgment to Eli Lilly & Co.
In a May 3 ruling, the New Jersey Superior Court, Appellate Division, said the plaintiff also failed to present evidence rebutting the presumption that Zyprexa was properly labeled.
Mary Scott was prescribed Zyprexa in 2008 to treat her schizophrenic effector, bi-polar and post-traumatic stress disorders. A different doctor increased Scott’s dosage in 2009.
