BIRMINGHAM, Ala — An Alabama federal judge has granted the manufacturers of generic Reglan judgment on the pleadings in an action accusing them of failing to update their labels to match those of the drug’s name brand counterpart, holding that the plaintiff failed to adequately plead causation.
In an April 29 order, Chief Judge Karon O. Bowdre of the U.S. District Court for the Northern District of Alabama held that while the plaintiff’s failure-to-update claim was not federally preempted, she did not provide factual support for her generalized allegations that her physicians prescribed Reglan based upon the drug makers’ representations.
