MIAMI –– The 11th Circuit U.S. Court of Appeals has upheld an award of summary judgment to Howmedica Osteonics Corp. in a case involving its EIUS Unicompartmental Knee System, finding the lower court did not abuse its discretion in refusing to allow the plaintiff to amend her complaint or denying motions to extend the discovery deadline.
In an April 20 opinion, the 11th Circuit U.S. Court of Appeals further held that the trial court properly excluded the expert testimony of the plaintiff’s sole causation expert.
