MONTGOMERY, Ala. — An Alabama federal magistrate judge has denied a plaintiff’s motion to compel responses to her discovery requests seeking information related to components of her Howmedica Accolade Hip System that had not been explanted, ruling that such information is not relevant.
On April 5, Magistrate Judge Gray M. Borden of the U.S. District Court for the Middle District of Alabama noted that none of the plaintiff’s experts testified to a defect involving the still-implanted components, and affirmed that they already had all of the information he needed to form their opinions.
