AUGUSTA, Ga. — A Georgia federal judge has allowed claims of design defect and failure to warn to proceed against Wright Medical Technology Inc. in a Profemur hip system action, ruling that the plaintiffs proffered sufficient evidence that the device was defectively designed and that the surgeon was inadequately warned of the risks.
However, in the March 31 order, Judge J. Randal Hall of the U.S. District Court for the Southern District of Georgia awarded Wright summary judgment on the claims of manufacturing defect and punitive damages, ruling that the evidence did not establish a material issue of fact.
