Durom Hip Cup Plaintiffs Withdraw Motion to Waive Common Benefit Fund Contribution

NEWARK, N.J. –– Plaintiffs with claims pending in the Durom Hip Cup national coordinated multidistrict litigation docket have dropped their motion to waive their contribution to common benefit fund after reaching an agreement with the plaintiffs’ liaison counsel, according to a consent order filed by the court.
In the March 23 consent order, the U.S. District Court for the District of New Jersey noted that plaintiffs’ liaison counsel said that it would withdraw its opposition to plaintiff Tracy and John Pelphrey’s motion and that the Pelphreys would pay two percent of their total settlement to the Common Benefit Fund.
