COLUMBUS, Ga. — Claims asserted against Mentor Worldwide LLC in connection with its ObTape Transobturator Tape are time-barred under Maryland law because the plaintiff knew or should have known by early 2009 that there was a connection between the suburethral sling and her injuries, yet waited until 2015 to file suit.
In a March 2 order, Chief Judge Clay D. Land of the U.S. District Court for the Middle District of Georgia said the plaintiff had a duty under Maryland law to investigate the potential causal connection between the device and her injuries.
