Plaintiffs Respond to Mistrial Motion in Ongoing Pinnacle Hip Implant Trial, Say Contested Evidence is Admissible

DALLAS –– Plaintiffs in a consolidated Pinnacle Hip Implant injury trial have responded to a defense mistrial motion, maintaining that the evidence categorized by the defendants as “highly inflammatory” is, in fact, admissible and relevant to the ongoing trial.
In the Feb. 23 brief, filed in the U.S. District Court for the Northern District of Texas, the plaintiffs noted that the defendants have made six oral motions for mistrial, each of which have been denied.
The seventh attempt, a written motion, only asserted the same grounds that were raised in the previous oral motions, the plaintiffs argued.
