JPML Rejects Efforts to Vacate Transfer Order in Case Relating to DePuy’s S-Rom Femoral Stem

WASHINGTON, D.C. –– Plaintiffs that filed a lawsuit relating to DePuy’s S-Rom femoral stem will be required to litigate their claims in the Pinnacle Hip Implant multidistrict proceedings, the JPML recently ruled after finding that discovery in the case will “likely” overlap with general discovery in the MDL docket.
In the Feb. 2 order, the U.S. Judicial Panel on Multidistrict Litigation pointed out that the plaintiffs themselves alleged in their compliant the defendant should have known that the Pinnacle acetabular component replacement system was unreasonably dangerous.
