Biomet M2a Hip Implant MDL Court Refuses to Remand M2a-Taper Case, Says ‘At Least Some’ Overlapping Issues Remain

SOUTH BEND, Ind. –– The federal court overseeing the coordinated docket for Biomet’s M2a-Magnum and M2a-38 hip implants has rejected a motion to remand a case involving the M2a-Taper implant, opining that “at least some” of the remaining discovery in the MDL docket on the Magnum and 38 cases will overlap with the Taper cases.
In the Feb. 8 order, the U.S. District Court for the Northern District of Indiana said that while the remand of the M2a-Taper cases might be appropriate later, the time for remand “hasn’t arrived.”
