OKLAHOMA CITY — An Oklahoma federal judge has awarded Corin USA summary judgment in a Cormet Advanced Hip Resurfacing System action, ruling that the plaintiff failed to support his negligence per se claims with evidence of a product defect.
In a Feb. 3 order, Judge Joe Heaton of the U.S. District Court for the Western District of Oklahoma noted that the opinion of Swisher’s sole expert is inadmissible as to whether Corin complied with industry standards. Without the expert testimony, the plaintiff failed to establish that the device was defective, the judge held.
