Durom Cup Plaintiffs Move to Waive Common Benefit Fund Contribution

NEWARK, N.J. –– Plaintiffs who recently settled claims arising out of an allegedly defective Durom Cup Acetabular Component have moved to waive their contribution to the Common Benefit Fund, saying that no other attorney but their own participated in the development of the case.

In a motion filed Jan. 28 in the U.S. District Court for the District of New Jersey, plaintiffs Tracy and John Pelphrey maintained that they did not “benefit from any substantive or procedural work product due to the efforts of the Plaintiffs’ Steering Committee in the Durom Cup MDL.”
