Defendants Move to Exclude Testimony in Ongoing Pinnacle Hip Implant Trial

DALLAS –– The defendants involved in a consolidated Pinnacle Hip Implant injury trial has moved to exclude the testimony of Dr. Bernard F. Morrey, contending that the plaintiffs are utilizing a “trial-by-ambush” strategy of characterizing their expert witnesses as non-retained experts.

In the Jan. 26 motion filed with the U.S. District Court for the Northern District of Texas, DePuy Orthopaedics Inc., DePuy Synthes Inc., Johnson & Johnson, Johnson & Johnson Services Inc. and Johnson & Johnson International said that since Morrey should be considered a retained expert, his testimony should be excluded since he did not file an expert report.
