La. Federal Judge Dismisses Fraud, Unfair Trade Practices Claims Against Medtronic in Infuse Bone Graft Action

MONROE, La. — A federal judge has dismissed fraud and Louisiana Unfair Trade Practices and Consumer Protection Act claims asserted against Medtronic in connection with its Infuse bone graft device, agreeing with a magistrate judge that they are subsumed by the state Product Liability Act.

On Jan. 20, Judge Robert G. James of the U.S. District Court for the Western District of Louisiana further ruled that the claims are prescribed.

Bryant Lyles alleges he suffered injuries after being implanted with the Atlantis Translational Anterior Cervical Plate System and the Infuse Bone Graft Device in May 2013. He asserted claims …
