CINCINNATI –– Parties involved in a bone cement case asserted against DePuy Orthopaedics have exchanged briefing on the plaintiff’s request to allow an economist to submit an expert report, with DePuy contending that it would be prejudiced by the late submission.
In an opposition brief filed Dec. 31 in the U.S. District Court for the Southern District of Ohio, DePuy said that the plaintiff’s decision “to defer disclosing an economic expert until the outcome of summary judgment does not warrant imposing the litigation equivalent of a fire drill on DePuy.”
