SAN FRANCISCO –– Defendants involved in California’s coordinated docket handling DePuy ASR Hip Implant claims have objected to the plaintiffs’ discovery and trial plan, saying that it is an “unworkable proposal that seeks to rush to select cases for trial within an unreasonable time frame without the benefit of discovery….”
In the Jan. 15 brief filed in the San Francisco County Superior Court, the defendants specifically objected to the plaintiffs’ proposed discovery and trial plan for opt-out cases, saying that the plan violates the defendants’ constitutional due process rights.
