4th Circuit Upholds Order Denying Bard’s Request for New Trial in Transvaginal Mesh Action

RICHMOND, Va. — A federal appeals court has affirmed an order denying C.R. Bard’s motion for a new trial in a transvaginal mesh case, ruling that the trial court did not err in refusing to admit evidence of 501(k) compliance because the evidence was not relevant to the question of whether the device was safe.

On Jan. 14, the 4th Circuit U.S. Court of Appeals further ruled that the trial court properly admitted the Material Safety Data Sheet that accompanied the polypropylene resin material into evidence and that it was not prejudicial to the defendant.
