CHARLESTON, W. Va. — A West Virginia federal judge has remanded a Boston Scientific transvaginal mesh action to Florida state court, holding that the nondiverse healthcare providers were not fraudulently joined because the claims against them arise from the same transaction.
On Nov. 20, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia further found that at least one common question of law or fact exists between the claims against BSC and the healthcare providers.
