Fla. Judge Refuses to Extend Expert Disclosure Deadline in Zimmer NexGen Knee Case

FORT MYERS, Fla. — A Florida federal judge has allowed a plaintiff to disclose three experts in a Zimmer NexGen artificial knee case past the court’s deadline, explaining that striking the experts is not warranted.

In an Oct. 21 order, Magistrate Judge Carol Mirando of the U.S. District Court for the Middle District of Florida reasoned that although the plaintiff failed to show good cause or excusable neglect in his failure to present the experts within the prescribed period, Zimmer will not be prejudiced because the discovery period does not end until Jan. 4.
