Boston Scientific Prevails on Negligent Design, Warranty Claims in N.C. Uphold Transvaginal Mesh Trial

STATESVILLE, N.C. — A North Carolina federal jury has found in favor of Boston Scientific Corp. in an Uphold transvaginal mesh case, concluding that the device maker did not act unreasonably in designing the device and did not breach the implied warranty of merchantability.

The jury, sitting in the U.S. District Court for the Western District of North Carolina, reached the verdict on Oct. 16 following a 10-day trial, according to the court docket. Judge Richard Voorhees presided over the proceedings.
