JPML Refuses to Vacate Transfer of Stryker Hip Implant Claims Brought by Orthopaedic Surgeon

WASHINGTON, D.C. –– The U.S. Judicial Panel on Multidistrict Litigation has rejected efforts by a orthopaedic surgeon to vacate the transfer of his claims to the Stryker Rejuvenate and ABG II Hip Implant multidistrict litigation docket, ruling that while the claims are unique, they still involve “significant overlapping factual allegations.”

In the Oct. 13 ruling, however, the panel did urge the MDL Court to remand the action if it found that the case would “no longer benefit from inclusion” in the docket.
