JPML Refuses to Vacate Transfer Orders in 2 Pinnacle Hip Implant Suits

WASHINGTON, D.C. –– The Judicial Panel on Multidistrict Litigation has declined to vacate transfer orders issued in two California Pinnacle Hip Implant lawsuits, concluding that “both actions involve injuries related to DePuy Pinnacle Acetabular Cup System hip implants and fall within the MDL’s ambit.”

In the Oct. 13 order, the JPML further found that it was convinced that both lawsuits would “benefit from the framework provided by the centralized proceedings for discovery and motion practice.”

The plaintiffs in Timms had asked the JPML to vacate their transfer order, saying that it was their preference to have the Central District …
