HOUSTON — Claims asserted against the makers of a pacemaker and right ventricular lead are federally preempted because the plaintiff sought to impose state requirements that are “different from, or in addition to” federal regulations.
On Sept. 30, Judge Melinda Harmon of the U.S. District Court for the Southern District of Texas further ruled that in his petition, the plaintiff failed to present factual support and only asserted legal conclusions that fail to state a claim.
