Zimmer Opposes Motion In Limine Relating to Role of Infection in Knee Implant Failure

CHICAGO –– Zimmer has filed an opposition brief to a motion in limine, arguing in part that it does not need to prove that an infection caused the plaintiff’s alleged injuries, but that the plaintiff must prove that it did not.
In the Sept. 18 opposition brief filed in the U.S. District Court for the Northern District of Illinois, the defendant also contended that the plaintiffs’ in limine motion –– in which the plaintiffs seek to exclude evidence that the knee replacement failed because of an infection –– is actually a “stealth” summary judgment motion.
