Plaintiffs with Claims in Calif. DePuy ASR Hip Docket Back Motion for Preferential Trial Setting

SAN FRANCISCO –– Plaintiffs with claims in the California DePuy ASR hip docket are seeking a preferential trial setting, arguing that the underlying plaintiff “easily” satisfies the criteria of qualifying for the expedited setting.

In the Sept. 15 reply brief filed in the California Superior Court for San Francisco County, the plaintiffs said that only case-specific discovery remains which, the plaintiffs say, can be completed in 120 days.

“The granting of trial preference for Mr. Lansbury will not prevent what remains of the coordinated proceeding from continuing in an orderly manner,” the reply brief stated.
