Stryker Files Reply Brief Backing Efforts to Dismiss Third Amended Hip Complaint

SAN FRANCISCO –– In support of its motion to dismiss a plaintiff’s third amended complaint, Stryker Corp. argues that the filing tenders “only naked assertions devoid of further factual enhancement.”

According to a Sept. 21 order, the U.S. District Court for the Northern District of California scheduled a hearing on the matter for Oct. 16.

James Bem sued Stryker and several healthcare providers in the Alameda County (Calif.) Superior Court, alleging that after he was implanted with Stryker’s Accolade hip replacement system, the device caused him pain and had to be removed.
