NEW YORK — A New York federal judge has dismissed an amended complaint in an Allergan breast implant case, ruling that the claims of manufacturing defect and breach of express and implied warranties were not adequately pled.
On Sept. 4, Judge Paul A. Crotty of the U.S. District Court for the Southern District of New York found the allegations were “vague and conclusory,” and not supported by specific facts.
In 2000, Allergan’s predecessor, McGhan Medical Corp., was granted conditional approval by the Food and Drug Administration to design, manufacture, distribute and sell saline-filled breast implants. As McGhan’s successor, Allergan agreed …
