DePuy Opposes Motion for Preferential Trial Setting, Says Plaintiff Hasn’t Satisfied Requirements of Expedited Trial Date

SAN FRANCISCO –– DePuy Orthopaedics Inc. has opposed a recent motion for a preferential trial setting in a hip implant case pending in California’s coordinated docket, saying that the motion has “triggered a race to the finish line,” with five other plaintiffs subsequently filing similar motions.
In its Sept. 9 opposition brief filed in the California Superior Court for San Francisco County noted that the plaintiff’s own orthopedic surgeon noted in his medical records that “there is nothing wrong with his ASR cup.”
