LOS ANGELES — A California federal judge has granted Eli Lilly & Co. judgment as a matter of law in a Cymbalta withdrawal case, finding the plaintiff failed to offer evidence that had her doctor conveyed stronger warnings, she would not have taken the drug.
On Aug. 18, Judge Steven V. Wilson of the U.S. District Court for the Central District of California further held that the plaintiff failed to offer sufficient evidence to allow a rational jury to conclude that she would not have taken Cymbalta had Eli Lilly provided stronger warnings.
