DePuy Moves for Summary Judgment in Bone Cement Case, Says Plaintiffs Failed to Prove Defect or Failure to Comply

CINCINNATI –– DePuy Orthopaedics has moved for summary judgment in a case involving its bone cement product, saying that the plaintiff has failed to prove that the product has a defect or failed to comply with federal requirements.
In the July 30 motion filed in the U.S. District Court for the Southern District of Ohio, DePuy further argued that the plaintiff’s bone cement expert’s opinions are “litigation-driven,” and are based on speculation.
