Zimmer Challenges Plaintiff’s Intent to Depose Fact Experts in NexGen Knee Implant Bellwether Case

CHICAGO –– Zimmer has challenged the plaintiff’s intent to depose two fact witnesses in an upcoming NexGen knee implant bellwether trial, saying that it still has no notice of what documents the plaintiff intends to ask the witnesses to produce or discuss.

In the Aug. 17 motion, filed in the U.S. District Court for the Northern District of Illinois, the defendant also said that the disclosure deadlines have passed “long ago.”

Bellwether plaintiff Kathy Batty alleged in her complaint that she underwent total knee replacements on both knees in April 2009 in effort to help her degenerative joint disease. Her …
