NexGen Knee Implant MDL Court Refuses to Throw out Defense Testimony in Bellwether Trial

CHICAGO –– The federal court overseeing the national NexGen knee implant products liability multidistrict litigation docket has refused to throw out testimony from Zimmer’s computer model expert, saying that the expert’s Finite Element Analysis follows “similar methodology” and is “as intellectually rigorous,” as other models used by other scientists.
In the Aug. 13 opinion, the U.S. District Court for the Northern District of Illinois wrote that the plaintiff would have the opportunity to criticize the model from diverging from realistic activities, but “those criticisms go to the accuracy and weight of the model, not its reliability.”
