COLUMBUS, Ga. — A Georgia federal judge has dismissed a lawsuit against Mentor Worldwide LLC involving its ObTape Transobturator Tape, ruling the claims are time-barred because the plaintiff knew, or should have known, of the alleged cause of her injuries by 2005.
On Aug. 10, Chief Judge Clay D. Land of the U.S. District Court for the Middle District of Georgia found Tennessee’s one-year statute of limitations was not tolled because the plaintiff presented no evidence that she attempted to discover whether a defect in the ObTape caused her problems.
