Defendants Oppose Pinnacle Hip Implant Plaintiffs’ Motion to Compel, Say Requests are ‘Premature’

DALLAS –– Defendants in the DePuy Pinnacle Hip Implant coordinated docket have opposed a recent plaintiff motion to compel them to declare information in their possession, calling the request “premature.”
In the July 24 opposition brief filed in the U.S. District Court for the Northern District of Texas, the defendants argued that it was “impossible for defendants to formulate their trial contentions before the facts on which those contentions are based have been made available to them and their experts.”
The opposition was filed in nine cases pending in the MDL that have been designated as bellwether trials.
