Plaintiff Allowed to Amend Warning, Express Warranty Claims in La. Seroquel Case

NEW ORLEANS — A Louisiana federal judge has dismissed claims of failure to warn and breach of express warranty in a Seroquel case, but allowed the plaintiff amend these claims to specify why AstraZeneca’s warnings were inadequate and how the drugs failed to conform to its representations.
In an Aug. 5 opinion, Judge Carl C. Barbier further ruled that the plaintiff may not remain anonymous, explaining that the plaintiff’s privacy interests do not outweigh the “almost universal practice of disclosure.”
Plaintiff, who sought to remain anonymous, alleges she suffered adverse effects from her use of AstraZeneca’s Seroquel and/or Seroquel XR. …
