Plaintiff’s Request for Further Discovery on Preemption Issue Granted in Ohio Sculptra Case

COLUMBUS, Ohio — An Ohio federal judge has granted a plaintiff’s request for further discovery on the issue of whether her claims against the makers of Sculptra are preempted and denied the defendants’ motion for summary judgment.
However, in the July 17 order, Judge Gregory Frost of the U.S. District Court for the Southern District of Ohio cautioned the plaintiff that if she does not perform the necessary discovery in the additional time allotted, she will not be given another opportunity to do so.
