GRAND RAPIDS, Mich. — Claims asserted against Zimmer in connection with its Versys Hip System are not time-barred under Michigan law because the plaintiffs have sufficiently alleged that their injuries occurred some time after implantation, rather than on the date of implantation, a federal judge has ruled.
On July 15, Judge Robert H. Bell of the U.S. District Court for the Western District of Michigan further found questions of fact exist as to whether the plaintiffs’ warning claims are barred by the learned intermediary and sophisticated user doctrines.
