Stryker Again Attacks Claims Asserted in Accolade Hip Replacement Lawsuit on Pleading Grounds

SAN FRANCISCO –– Stryker has again moved to dismiss a lawsuit involving its Accolade hip replacement system, reasserting challenges to the plaintiff’s allegations, specifically whether the complaint pleads facts sufficient to state claims for relief.
In the July 7 motion filed in the U.S. District Court for the Northern District of California, Stryker Corp. additionally said that the plaintiff also asserts a claim for punitive damages that fails to meet requirements outlined in California law.
