Lilly Awarded Summary Judgment on Claims Attacking Post-2004 Zyprexa Warnings

RENO, Nev. — A Nevada federal judge has awarded Eli Lilly & Company Inc. summary judgment on claims that it failed to adequately warn doctors that Zyprexa may cause type II diabetes and hypoglycemia in its post-2004 labeling.

However, in the July 10 order, Judge Larry R. Hicks of the U.S. District Court for the District of Nevada denied the drug maker’s motion for summary judgment as to warnings in its pre-2004 labeling, explaining that expert testimony regarding causation is still needed.
