Zimmer Awarded Summary Judgment in M/L Taper Femoral Stem Hip Implant Action

ERIE, Pa. — A Pennsylvania federal judge has awarded Zimmer summary judgment in an M/L Taper Femoral Stem hip implant action after agreeing with a magistrate that the testimony of the plaintiffs’ experts should be excluded.

On July 6, Chief Judge Joy F. Conti of the U.S. District Court for the Western District of Pennsylvania ruled that the first expert should have submitted an expert report and the testimony of the second expert is barred by the sham affidavit doctrine.
