CHARLESTON, W. Va. — The makers of Levaquin are not liable for injuries allegedly sustained by a woman after she ingested the drug’s generic equivalent, a West Virginia federal judge has ruled, explaining that there is no authority for the assertion that one manufacturer can be held liable for injuries stemming from another manufacturer's product.
On June 26, Judge John T. Copenhaver of the U.S. District Court for the Southern District of West Virginia granted the defendant drug makers’ motion for summary judgment.
