CLEVELAND - An Ohio woman who allegedly suffered from kidney failure as a result of using Vioxx claims that the manufacturer failed to warn physicians and consumers about the arthritis drug's ability to cause such complications. Rose Rocca v. Merck & Co., Inc., et al., No. CV-02-488680 (Ohio Ct. Comm. Pleas, Cuyahoga Cty.).
In addition, plaintiff Rose Rocca's products liability suit states that the manufacturer should have known about the drug's association with kidney failure and the omission of this information from the product's package insert demonstrates 'a flagrant disregard for human life.'
