NEW ORLEANS - The plaintiffs' steering committee in MDL 1355 has submitted a preliminary trial plan for medical monitoring and restitution class claims, outlining three phases to determine liability, relief, and whether medical monitoring is appropriate. In re: Propulsid Products Liability Litigation, MDL No. 1355 (E.D. La.).
In accordance with the court's Pretrial Order No. 15, plaintiffs submitted their proposed trial plan Jan. 3, accompanying their motion for class certification for medical monitoring claims, in an attempt to address immediate and predictable management issues.
