DePuy ASR Hip Implant Plaintiffs Seek Remand, Say Each Plaintiff Deserves Trial in ‘Reasonable Time’

SAN FRANCISCO –– Plaintiffs who opted out of settlement for DePuy ASR Hip Implants have asked a California state court to remand their claims, saying that while the case has been pending for four-and-a-half years, no trial date has been set.
In the June 1 motion filed in the California Superior Court for San Francisco County, the plaintiffs argued that the delay inconveniences everyone involved.
Barry and Lisa Keen filed the case in the Los Angeles Superior Court in Jan. 2011, alleging that Barry Keen suffered injury after undergoing bilateral implants and four revision surgeries. Judge Richard Kramer …
