TAMPA, Fla. — A Florida federal judge has awarded C.R. Bard Inc. summary judgment on a failure-to-warn claim in a G2 IVC filter case, finding the plaintiff failed to establish that the device’s instructions for use did not adequately warn the implanting surgeon of the risk of perforation.
In a June 3 order, Judge Charlene Honeywell of the U.S. District Court for the Middle District of Florida also awarded Bard summary judgment on the manufacturing defect and negligent misrepresentation claims, finding the plaintiff failed to present evidence that the filter varied from other filters in its lot and that Bard …
