Plaintiffs in DePuy Pinnacle Hip Implant MDL Support Efforts to Protect Mental Health Records

DALLAS –– Several plaintiffs with claims pending in the national DePuy Orthopaedics Inc. Pinnacle Hip Implant Products Liability Multidistrict Litigation docket have support their efforts to protect mental health records, saying that both health authorizations and Texas law recognize a right to revocation.
In the June 1 brief filed in the U.S. District Court for the Northern District of Texas further maintained the plaintiffs further maintained that their mental health history “is not a part of either the Plaintiffs’ claims or the Defendants’ defenses such that it satisfies the patient-litigant exception to warrant discovery of Plaintiffs’ mental health records.”
